Some claim that Senate president pro tempore David Atchison became “President of the U.S. for a day” because of the lag. The logic is questionable. James Polk’s presidential term might have ended at noon on Sunday, March 4, but so did Atchison’s Senate term. Moreover, it’s not clear that the oath is necessary for a person to *be* President. It may only be necessary before he tries to exercise presidential powers. Either way, Atchison himself never made the claim that he’d been acting President. He did, however, like to joke that his was “the honestest administration this country ever had.” ;)
